Step 1 – grant Disney a license to make a bunch of multiversal cross-over movies with the DC/Marvel characters

Step 2 – DO NOTHING ELSE

    Step 3 – profit!

No joke, this sounds like a great idea.

I think Flash may be next year’s write down for tax purposes for WB-Discovery. I really don’t see how they can release it theatrically and is not be box office poison.

Work has kept up on The Flash, which has been testing well. Miller participated in regularly scheduled additional photography over the summer, apparently without incident, before being charged with burglary — their third arrest this year — on Aug. 7 in Vermont. Still, neither DC nor Zaslav has indicated the film will move from its June 2023 release date, though insiders say the studio is evaluating all options.

Normally I don’t care about Celebrity Worship Cult Of Personality shit like what’s going on in the private life of some USistani millionaire I saw in a few movies, but given that the future of The Flash movie seems to be in mild peril based solely on the behaviour of its lead actor (is that gender neutral? actee? actoress?) I think this story might interest us as fans and thus belongs here:

Ezra Miller breaks silence to apologise ‘to everyone that I have alarmed’

“Having recently gone through a time of intense crisis, I now understand that I am suffering complex mental health issues and have begun ongoing treatment,” Miller said.
“I want to apologise to everyone that I have alarmed and upset with my past behaviour. I am committed to doing the necessary work to get back to a healthy, safe and productive stage in my life.”

I hope they can forgive themselves and actually see the error of their ways. And move on. I’ve been in similar spots myself, and forgiving yourself is key to progress (thanks @Todd). No-one gets any cleaner by rolling around in the dirt.

I mostly hope they aren’t just saying that simply to keep WB from killing the movie and that they’re actually serious. The cynic in me finds the timing suspicious, coming right on the heels of headlines about WB seriously weighing whether or not to move forward with releasing the film. Here’s hoping it’s sincere. Probably both. I don’t doubt the guy has problems (although my sympathies still lie more with the victims at this point) but either way WB need to detoxify Miller somehow if they want to move ahead with someone with that history headlining a huge tentpole movie.

Based on what has been said, I don’t think they were going to shelve the movie. The probable case scenario would have been to screen the movie and leave Miller out of the press for it.

As of now, I can see Miller being on a very short and tight leash for the next year. I wouldn’t be surprised if he keeps a very low profile.

It seems like every move Warner Brothers Discovery makes, they just look worse and worse. To get out of debt, they’re gutting content. the Superman character will be public domain

The original works fall out of copyright which is a different thing. I read a long article about the Steamboat Willy thing which showed why it isn’t as potentially damaging as some may think.

Firstly you could not sell anything with the name Superman or the S-Shield on the cover as they will remain trademarks, which have different rules. Same with the Mickey Mouse name and ears logo. You could republish the exact contents of Action Comics 1 under a different name on the cover, you could make derivative works based on the contents of that issue but you couldn’t have anything that appears later until that falls into public domain too.

So really, at least initially there isn’t a huge amount you can do with the material even if Disney/DC etc don’t contest it. You could make your own Steamboat Willy era cartoons or a golden age Superman era comic but does anyone want to buy those? Mickey Mouse is effectively a corporate logo nowadays and you’ll see they don’t expire – the Coca Cola logo was drawn up in 1885.

  • #98435

Steamboat Willy’s Clubhouse sounds like a right kinky cartoon.

or… Like the way Chris Ware used Superman. Technically “parody” but really a dramatically different version of the character.

There is an interesting story where fighting to protect IP could end up with some strange consequences. I can’t remember the name of the strip (“Ricky Rat”) maybe, but essentially it was a porno comic that used parodies of Mickey and Minnie Mouse.

Disney sued saying the creator violated their intellectual property as the characters looked exactly the same as theirs.

However, since they won, then essentially Disney legally turned a porno parody of their characters into an actual Mickey Mouse porno since the basis of their argument is that the cartoonist used the actual Mickey, Minnie, Pluto etcetera without their authorization. So if you asked Disney if Mickey Mouse ever appeared in a porno, by their own legal arguments in this case, the answer would have to be yes.

The stranger headache here is that the people who own the IP are not the same people that created it or even related to them. It’s not like the Tolkien estate or any other novelist in that regard. The fundamental ownership of the characters in comics often is the result of extremely exploitative industry practices which has led to cases and laws that claw back representation for these writers, artists and their surviving families.

On the other side, the corporations could argue that in the case of comics, their stewardship also involved significant investments and, honestly, most of these characters no longer resemble the original versions – especially in the case of DC where the golden age originals are nothing like the comics that came out under different creative teams in the ensuing decades.

However, that is simply the way it turned out. We don’t know what would have happened had the original authors retained control of the copyright, but we can see it working that way with modern, more savvy creators – like in the case of Harry Potter.

  • #98446

The stranger headache here is that the people who own the IP are not the same people that created it or even related to them.

Yes and to be fair the article Al posted alludes to that. Up until now the public domain situation has mostly been around novels and written fiction, poetry or art. Those have for the most part worked with a simple model that the author owns the IP but the publisher owns the right to reproduce it until it isn’t useful to them. Alan Moore signed a typical book contract for Watchmen and V For Vendetta with no idea that the model was going to change radically, that a previously periodical model was going to change into material being permanently in print.

Properties like Mickey Mouse or Superman are different. They have been taken over by the publishers as work for hire in the 1930s. Now as the protections expire we are in a new arena.

Steamboat Willy in the next year or two really is a test case, even if nobody really gives a shit about the specific cartoon, it is really the first release of that kind that will be tested by the courts. However it is important to note that even if Disney do nothing it doesn’t mean everyone can launch their own Mickey Mouse Club TV show and Mickey Mouse comic. They don’t own the trademark, Disney do and they’ll renew that forever.

Warner Bros. Execs Reportedly Regret Releasing the Snyder Cut, Citing Fan Aggression

    While on the other hand…

    https://comicbook.com/dc/news/zack-snyder-justice-league-hbo-max-viewer-numbers-ratings-revealed-official/#:~:text=Zack%20Snyder's%20Justice%20League%20viewership,offerings%20on%20streaming%20throughout%202021.

Zack Snyder’s Justice League viewership numbers have finally been revealed. According to reports, The Snyder Cut of Justice League was viewed 2.2 million households in its first week, as one of HBO Max’s big blockbuster theatrical offerings on streaming throughout 2021. In fact, the viewership numbers for Zack Snyder’s Justice League were only released in reference to how Warner Bros. and HBO Max’s currently big DC movie offering, The Batman, is faring. Comparatively, The Batman was viewed by 4.1 million households in hits first week, marking a new high for DC/WB and their brand strategy for balancing streaming and theatrical success in the post-pandemic era.
Here’s the report that appeared in Deadline: “The Batman’s first week was even bigger than Zack Snyder’s Justice League which pulled in 2.2M U.S. households, that pic a direct to HBO Max title.”
    […]
That all said, Warner Bros. was only able to achieve the current streaming success of The Batman due, in part, to the major “event” release that was Zack Snyder’s Justice League. Justice League gave HBO Max the biggest increase in downloads of any streaming service up to that point, and definitely gave HBO Max a timely bump in its subscriber base.

So it does seem to have worked well enough for them.

Moot points though, I’d expect. Snyder’s gone from the cinematic DCU, and that’s that.

  • #98672

So it does seem to have worked well enough for them.

Pshh… watchu talking about… those were all bot views.

Didn’t you get the memo? Snyder fans are all a bunch of magical bully-bots that bring massive multibillion corporations into submission and destroy fandoms with their fan agression… oh they also sacrifice puppies.

Nice numbers for the snydercut, considering it’s a 4-hour long director’s cut of a movie a lot of people didn’t care for…

And good numbers for the Batman too… though I’m sure WB would’ve prefered more theatrical money… I’m not sure if that whole thing worked well or not for them… I mean, sure they can brag about the numbers, but is that really a good thing financially speaking? Probably not considering how Zaslav is gutting the shit out of HBOmax.

Just searching around. Don’t bother clicking on the clickbait.

Christopher Reeve Had Some Stiff Competition For The Role Of Superman

…Sylvester Stallone for the role. Stallone was an already-established star — the kind producer Alexander Salkind was drawn toward. Donner, on the other hand, wanted an “unknown” actor, someone unexpected.

Donner revealed that several actors wanted to play Superman. In fact, the filmmaker was given a list of names, but he felt that viewers wouldn’t be convinced by big stars like Paul Newman or Robert Redford wearing the cape. It had to be someone new.

“Anyway, one of the actors comes in and it’s this kid, Chris Reeve. He walks in; he’s got this great big sweater on, blondish hair. I said, ‘What’s under the sweater?’ And he says, ‘Well …’ He has this thick sweater on and he’s this skinny kid. I said, ‘Problem quite honestly, buster, is I got to get a guy that is bulk, that looks like a muscle zoo.’ He said, ‘Listen, I was a jock in school and when I went into acting I lost 50 pounds.’ I said, ‘I don’t believe you — you’re an actor.’ He says, ‘No, I did. I swear to you.'”

Good for Donner on winning that one. Reeve was perfect, and how often can you say that and mean it?

I got to get a guy that is bulk, that looks like a muscle zoo.

The great thing about Reeve is that he didn’t have a lot of bulk. He looked like he worked out, but he didn’t look like he lived in a gym. If he did, it would have been wrong. He looked like a Curt Swan drawing, and obviously that’s perfect.

I hope Cavill does come back. I liked him as superman. I think he did a good job given the circumstances and how superman was characterized in the DC movies. I think while Snyder’s films have a very divided response and we’re poking fun at the mess that DC films seem to be in, Cavill was pretty universally praised as Superman. I didn’t read much criticism of him (again outside poking fun at the CGI moustache debacle which isn’t his fault).

    Peacemaker Series 1

Much in the way that The Suicide Squad saw Gunn identifying what DC could do in film that the MCU wouldn’t, this continues in the same direction. (The MCU could do what is done here but not without departing from its target demographic.)

What follows is a superhero epic but a decidedly subversive one.  It’s aided in this by excellent casting across the board, with Cena demonstrating quite the range.  At the same time Patrick makes a very scary villain as Peacemaker’s white supremacist father.

Like Gunn’s other works, music features strongly in this.  The result is an excellent soundtrack and a brilliant opening dance sequence.

At eight episodes, it is a well paced show without any padding.

Oh yeah, Cena can also play the piano.

Constantine is similar to Blade Runner in that it was a bit of a flop (not as much as a flop as Blade Runner, though) that caught on with fans over the years. It also took a noir detective approach and departed significantly from the source material like Blade Runner as well.

A sequel could be interesting, but I agree there probably isn’t as much demand for it as there is for something like Edge of Tomorrow or another Dredd – and there really isn’t that big a demand for those two as well.

What’s with all these far-too-late Keanu sequels?

    Speed 3: Mobility Scooter Mayhem!

Speed 4. Father Ted already did Speed 3.

After bringing back The Matrix last year, Warner Bros. is reviving yet another Keanu Reeves property. The studio is developing a sequel to 2005’s Constantine, the film based on the supernatural DC property, The Hollywood Reporter has confirmed.

The project is to reunite Reeves with director Francis Lawrence, who helmed the original. This time around, veteran scribe Akiva Goldsman will write the script. Goldsman will also produce via Weed Road Pictures, with J.J. Abrams producing via Bad Robot with Hannah Minghella.

Abrams has been developing a Constantine series for HBO Max; however, it will not be moving forward there. It’s possible it could find life elsewhere. The same is true of Madame X, another Abrams-produced DC project that will no longer have a home on HBO Max.

That’s the textbook definition of too little too late… I absolutely LOVE Constanine, but even I don’t want to see a sequel at this point… Keanu’s starting to show his age (specially if he’s shaved) so I’m not sure I want grandpa Constantine… or John Wick playing Constantine… =/

You know, I think I’d be fine with Old Man Constantine. It’d be kinda cool if they leaned into it, like in Delano’s Bad Blood mini.

On the other hand: Akiva Goldsman is writing the script, so it’s going to be shit no matter what.

Akiva Goldsman: Ruining films since 1995*.

(This was when he wrote Batman Forever.)

A friend yesterday told me he’d watched Man of Steel for the first time. He started discussing some intricacies of a plot concerning gene banks or something, and I was like, what are you talking about? Superman killed Zod, what did gene banks have to do with it?

Then I realised I can’t actually remember the plot of Man of Steel :D

He’ll cop a plea deal for time served, probation, and a fine. He won’t serves any jail time. WBD lawyers will see to that.

Why do they call him “Flash star”? As far as I know, there is no movie called “Flash” that he has starred in :-)
